Acceptance of General Terms and Conditions of Sale
1. The contract concluded between piratamodels.it and the Customer shall be deemed finalized with the acceptance, even partial, of the order by Piratamodels. Such acceptance shall be considered tacit unless otherwise communicated to the Customer by any means. By placing an order through the various methods provided, the Customer declares to have read all the information provided to them during the purchase process and to fully accept the general terms and conditions of sale and payment outlined below.
2. If the Customer is a consumer (i.e., a natural person who purchases goods for purposes not related to their professional activity), once the online purchase procedure is completed, they must print or save an electronic copy and, in any case, keep these general terms and conditions of sale, in compliance with Articles 3 and 4 of Legislative Decree 185/1999 on distance sales.
3. The Customer has no right to claim compensation or damages, nor any contractual or extra-contractual liability for direct or indirect damages to people and/or property, caused by the non-acceptance, even partial, of an order.
Purchase Methods
4. The Customer may purchase only the products listed in the electronic catalog of piratamodels.it at the time of placing the order and viewable online at the URL piratamodels.it, as described in the respective information sheets. It is understood that the image accompanying a product description may not perfectly represent its features and may differ in color, size, or included accessories. All purchase support information is to be considered as generic informational material, not directly referring to the actual characteristics of a specific product.
5. The correct receipt of the order is confirmed by piratamodels.it via an email sent to the email address provided by the Customer. This confirmation message will include a 'Customer Order Number,' which must be used in all further communications. The message reproduces all the data entered by the Customer, who undertakes to verify their accuracy and promptly communicate any corrections, according to the methods described in this document.
Payment Methods
6. The following payment methods are available:
- Bank transfer;
- Credit card, except for AMERICAN EXPRESS;
- PayPal and PayPal Pay in 3 installments;
- Klarna;
- Satispay.
For direct sales, payment can be made in cash, debit card, or credit card.
Delivery Methods and Costs
7. For each order placed on piratamodels.it, the company issues an invoice or tax receipt for the shipped goods, sending it to the order holder, in accordance with Art. 14 D.P.R. 445/2000 and DL 52/2004. The document is based on the information provided by the Customer at the time of the order. No changes will be possible after its issuance.
8. Delivery costs are borne by the Customer.
9. piratamodels.it cannot be held liable for any delay in order processing or delivery of the ordered goods.
10. Upon delivery of the goods by the courier, the Customer must check:
- that the number of packages delivered matches the number indicated in the transport document sent via email;
- that the packaging is intact, undamaged, not wet, or otherwise altered, including the sealing materials (adhesive tape or metal strapping).
Any damage to the packaging and/or the product or discrepancies in the number of packages or information must be immediately reported by writing a WRITTEN RESERVE NOTICE on the courier's delivery proof. Once the courier's document is signed, the Customer may no longer raise any objections regarding the external condition of the delivered goods.
Any issues concerning the physical integrity, correspondence, or completeness of the received products must be reported within 7 days of delivery, according to the procedures outlined in this document.
11. If the goods are not collected within 5 working days of being held at the courier's warehouse due to repeated failed delivery attempts to the address provided by the Customer at the time of the order, the order will be automatically canceled, and all storage costs will be charged to the Customer. Please always include an active phone number in the order.
Right of Withdrawal
12. Pursuant to Art. 5 of Legislative Decree 185/1999, if the customer is a consumer (i.e., a natural person who purchases goods for purposes not related to their professional activity, or who does not indicate a VAT number on the piratamodels.it order form), they have the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as specified in point 15 below.
13. To exercise this right, the customer must send piratamodels.it a communication to that effect within 10 working days from the date of receipt of the goods.
